Terms & Conditions
1. Definitions in the Contract
“Booking” means the booking by a Client of a Jetski Experience, RYA Training Course, RIB/boat Charter or other experience provided by New Wave Training.
“Client” means the person or persons named on the Booking Form as wishing to participate in activities or hire Equipment from New Wave Training for leisure or training purposes for a specified period. In the case of more than one Client, the Clients shall each be jointly and severally liable under this Contract.
“New Wave Training” means NW Consulting Dorset Ltd (formerly trading as Jetski Safaris Limited), a company registered in England.
“Charges” means the amounts payable, exclusive of any applicable VAT, in respect of any Booking.
“Deposit” means any deposit paid by the Client in respect of a Booking, where applicable.
“Equipment” means any boat, personal watercraft (jetski), RIB, tender, vessel or associated equipment, together with any accessories, provided or used by New Wave Training in delivering activities or courses.
“Period of Hire” means the duration of the provision of Equipment and/or instruction to the Client, as set out in the Booking.
“Working Days” means Monday to Friday, excluding public holidays.
“Terms and Conditions” means the terms and conditions set out below.
2. Booking Agreement
2.1 The Client acknowledges that no statement or representation, expressed or implied, made by or on behalf of New Wave Training has induced the Client to enter into the Contract other than as expressly set out in these Terms and Conditions.
2.2 New Wave Training reserves the right to decline any Booking at its discretion.
3. Age Limits and Unsuitable Clients
3.1 Clients must meet the minimum age requirements applicable to the specific activity or RYA course booked. All Clients must be physically fit, able to swim, and capable of safely participating in the activity. By making a Booking, each Client warrants that this is the case.
3.2 New Wave Training reserves the right at its sole discretion to refuse participation to any Client who does not meet safety, health, age or competency requirements.
3.3 Where Equipment is used by a Client together with guests or other participants, full details must be provided at the time of Booking. Responsibility for guests rests solely with the Client.
3.4 New Wave Training may cancel any Booking made in contravention of this clause at any time. Where a Deposit has been paid, it may be retained. Any refund of remaining Charges shall be at the discretion of New Wave Training.
3.5 New Wave Training may cancel or terminate participation before or during an activity where a Client’s behaviour, fitness, experience, or condition (including suspected alcohol or drug use) presents a safety risk.
4. Cancellations and Changes
4.1 Bookings may not be cancelled or amended except as provided in these Terms and Conditions.
4.2 Client cancellations must be notified in writing at least twenty-one (21) Working Days prior to the Period of Hire or Course.
4.3 Where cancellation is made more than twenty-one (21) Working Days before the Period of Hire or Course, the Client shall be entitled to a refund of Charges paid, less any Deposit paid.
4.4 Where cancellation is made between fourteen (14) and twenty-one (21) Working Days before the Period of Hire or Course, the Client shall be entitled to a refund of 50% of the Charges paid, less any Deposit paid.
4.5 Where cancellation is made less than fourteen (14) Working Days before the Period of Hire or Course, no refund shall be due, except where cancellation is due to a medical condition declared on the Booking Form and supported by medical evidence. In such cases, New Wave Training may, at its discretion, offer a refund or credit.
4.6 Where adverse weather conditions, safety concerns, mechanical failure, instructor unavailability, or other circumstances beyond reasonable control prevent the activity from taking place, New Wave Training shall offer a refund, credit, or alternative date. Where a Deposit has been paid, this shall be excluded from any refund unless otherwise agreed.
4.7 Where a Booking is cancelled during the Period of Hire due to the circumstances outlined above, a reasonable refund may be offered based on the proportion of the activity completed.
5. Price and Payment
5.1 Charges are subject to review and may be amended prior to Booking confirmation.
5.2 Written quotations are valid for thirty (30) days from the date of issue.
5.3 Where applicable, a Deposit may be required at the time of Booking. Deposits are non-refundable and non-transferable unless New Wave Training cancels the Booking.
5.4 Where full payment is taken upfront and no Deposit is applied, refunds shall be calculated strictly in accordance with Clause 4.
6. Maintenance
6.1 New Wave Training undertakes regular maintenance and safety checks of all vessels and equipment in accordance with manufacturer and RYA guidance.
6.2 In the event of mechanical failure, reasonable efforts will be made to complete the activity or provide a suitable alternative.
6.3 New Wave Training shall not be liable for consequential losses arising from mechanical issues. Refunds remain subject to Clause 4.
7. Insurance
7.1 New Wave Training maintains public liability insurance. This does not cover personal injury, personal belongings, or personal accident insurance for Clients.
8. Liability
8.1 Participation in watersports and boating activities carries inherent risks. Clients participate at their own risk. Liability is excluded to the fullest extent permitted by law.
8.2 All Clients must sign an indemnity waiver prior to participation. Group bookings require individual waivers from each participant.
8.3 Where there is more than one Client, liability shall be joint and several.
9. Damage
The Client shall be liable for any damage caused to Equipment while under their control and shall be responsible for all associated repair and recovery costs.
10. Breach, Waiver and Amendment
10.1 New Wave Training may terminate participation without notice where a breach of these Terms occurs. No waiver or amendment shall be valid unless agreed in writing.
11. Gift Vouchers
Gift vouchers are dispatched electronically or by post as agreed at the time of purchase. Vouchers are non-refundable and subject to expiry terms.
12. Law
These Terms and Conditions shall be governed by and construed in accordance with English law.
